摘要
Meta-tag是HTML中的一种语法参数,网页设计者将其嵌入网页源代码中成为搜索引擎关键词检索和排序的依据。当Meta-tag埋设行为人将他人商标作为自己网站的Meta-tag埋设即引发新类型的知识产权纠纷。本文即针对这一新类型纠纷,借鉴了国外初始混淆、商标淡化、显著性、合理使用等理论探讨解决Meta-tag纠纷的法律路径并立足我国提出了相关建议。
Meta-tag is one of the syntax' s parameters in Hyper Text Markup Language of computer.It is always be mined in web sound codes for web searching.If someone uses the trademark owned by other companies or other people as Meta-tag in his web,it will bring on a new type of Intellectual Property litigation.Aimed at this new type litigation, this article used some theories such as initial interest confusion,trademark dilution,distinctive character,fair and reasonable use and so on for references,and gave some ideas about the resolution of the Meta-tag's litigation.At the end,this article also tabled some proposals on the interrelated problem in China.
