论政府对国内通讯实行实时电子监控的能力受《爱国者法》的影响

The Patriot Act's Impact on the Government's Ability to Conduct Electronic Surveillance of Ongoing Domestic Communication

摘要 自从窃听装置发明后,美国政府为了保障国家安全就不断进行电子监控。在这个过程中,国会也制定一系列法律来规范这一政府行为。然而"9·11"事件之后,美国国会又专门制定了《爱国者法》,以使联邦政府机关更容易识别和调查恐怖活动。本文试图分析《爱国者法》对原有电子监控法律的主要修改以及这些修改对隐私权保护的影响。 Since the invention of the wiretap, electronic surveillance leaded by government has been a reality, on the grounds that doing so is necessary to protect national security. However, after '9. 11'attacks, Congress specifically enact USA Patriot Act of 2001 in order to assure that government can identify and investigate terrorist activity. This note tries to analysis both main modifications made by USA Patriot Act to the preexisting electronic surveillance law and those modifications' influence on privacy protection.
