专利确权案件中的网络证据真实性认定

在涉及网络证据的专利确权案件中,真实性认定是难点和争议焦点。目前《专利法》及其《实施细则》和《审查指南》均没有对网络证据的审核认定作出特别规定,专利复审委员会在实践中一般是从网络证据的特点出发,结合双方当事人的证据提交情况和相关经验法则,综合判断作出认定。本文在对网络证据特点进行分析和比较法研究的基础上,运用实证分析的方法,对目前的审查实践中网络证据真实性的审核认定方法进行梳理并给出法理分析,旨在为建立适应我国专利确权案件审查需要的网络证据法律制度提供参考。

In the patent right verification cases which relate to the network ev-idence, the identification of the evidence ’s authenticity is the focus and difficulty . But at present there aren ’t special provisions about this question in the Patent Law or the relevant rules or the Guidelines for Examination .In practice , the objective and impartial verification stems from the understanding of the characteristics of that kind of the evidences , the submitting of the evidence , and the rule of thumb .And in the future we should build the legal system of the network evidence applicable to <br> needs on the basis of both learning foreign instance of legislation and summing up the examination experience step by step .
