摘要
标准化中的合理无歧视原则来源于产业实践,目前还没有清晰的法律地位。从专利法和反垄断法看,都没有直接与合理无歧视原则对应的规则。合理无歧视的法律性质应当界定为一种合同性质的义务,其特征包括自愿性、不可撤回性、对世性和内容的不确定性。合理无歧视原则对于推进标准制定能够发挥积极的作用,但是实践也要求它被赋予更加具体充实的含义。
RAND Principle in Standardization comes from the industry prac-tice and has no clear legal status yet .There are no direct rules in both Patent Law and Anti-monopoly Law to regulate RAND .RAND’s legal nature shall be defined as a contractual duty .It is voluntary , irrevocable , toward unspecific person and with uncertain content .RAND has positive function in facilitating standard setting process , but the practice also needs more specific content of this rule .
