英国《数字经济法案》综述

为了应对信息时代的挑战,促进英国经济的复苏与发展,英国政府于2008年启动了"数字英国计划",随后于2009年11月颁布了《数字经济法案》,从而拉开了建设"数字英国"的序幕。《数字经济法案》共48条,主要涉及网络著作权侵权的治理、增加电子出版物的公共借阅权、更改域名注册规则、广播电视管理规则的修改,以及视频游戏的管理等问题。该法案一经颁布,便引起英国全国范围内的巨大争议和广泛讨论,尤其是有关网络著作权侵权的规定遭到各方的质疑。但《数字经济法案》毕竟标志着英国在保护网络著作权、促进信息化发展的道路上迈出了积极的一步,为其他国家发展数字经济提供了宝贵的借鉴经验。

For the purpose of confronting the challenges from the Information Age, as well as promoting the recovery and development of the economy , in 2008, the British government launched “Digital Britain Plan”, followed by the promulga-tion of the“Digital Economy Act 2010” in November, 2009.The act contained 48 articles, covering a wide range of aspects including protecting online copyright , public lending right for digital publications , regulations for domain name register , <br> and regulations for radio , TV and video games , etc.Great dispute flooded the country as soon as the act went public , among which the articles addressing online copyright protection were caught in the harshest criticism .However , the “Digital Economy Act” is a milestone that marks that Britain has taken a brave step forward to protecting online copyright and promoting informatization , which is a valuable experience for other countries to learn from .
