人工智能技术的法律规制——以“无人驾驶汽车”为例

On the Legal Regulation of Artificial Intelligence Technology: Take the Pilotless Automobile as the Example

无人驾驶汽车的社会化应用,不仅强烈地冲击了我国的现行交通法律秩序,而且引发了诸多科技风险、社会风险、伦理风险。在这种风险规制压力下,我国正在经历着深刻的法治变革,以期能够适应和引导人工智能技术的研发、应用与推广,并防范高科技产品的伴生性后果。面对无人驾驶技术的规制需求,我国应当在借鉴和吸收国外规制措施的基础上,率先确立无人驾驶汽车“道路行驶资格”,并结合我国当前无人驾驶技术的发展需要,建立公私协作的无人驾驶汽车治理模式、市场评价与长效监管机制以及“特许经营合同”规制机制。

The social application of driverless vehicles not only strongly impacted the current legal order of traffic in our country f but also triggered many scientific ,social and ethical risks. Under this risk regulation pressure, our country is experiencing a profound change in the rule of law so as to be able to adapt to and guide the development, application and promotion of artificial intelligence technologies and prevent the accompanying consequence of high-tech products. Faced with the regulatory requirements of driverless technology , our country should take the lead in establishing the “road driving qualification” of unmanned vehicles on the basis of reference to and absorbing foreign regulatory measures. In combination with the current development of unmanned technologies in our country, we should establish public-private cooperation Driverless vehicle management model , market evaluation and long-term regulatory mechanism , and the “franchise contract” regulatory mechanism.
