网络表情包产业发展困境与著作权治理研究

网络表情包作为移动互联网时期被普遍使用的沟通和表达工具,其一方面推动了表情包产业的发展,另一方面因其小巧的作品形式、极低的创作门槛、极快的传播速度和极广的使用范围的特点,也加大了著作权保护难度。使用非表情包作品,可能因无因管理和合理使用免责。使用表情包作品,收藏、修改和发送行为都可能侵犯著作权。网络平台使用表情包,间接侵权承担过错责任,直接侵权承担严格责任。鉴于表情包侵权泛滥,应引入戏仿行为,认可默示许可,限制私人复制,对网络时代的合理使用再解释。随着表情包潜在商业价值的发掘,将有更多网络表情包范围外的侵权行为。鉴于表情包著作权保护的困难,应加强创作者维权意识,网络平台维权责任和第三方监管力度。

The network expression packets are widely used as the communication and expression tool in the mobile Internet.On the one hand,they promotes the development of facial expression pack industry,on the other hand,they also increase the difficulty of copyright protection because of their small work form,low creation threshold,fast transmission speed and wide range of use.It is of no responsibility to use non-expression package works,may be due to non-cause management and reasonable use.The use of expression package works,collection,modification and transmission behavior may infringe copyright.Network platfoem use expression package indirect infringement bear the fault liability,direct infringement bear strict liability.In view of the overflow of the expression packet infringement,we should introduce the parody,admit the implied license,restrict the private copy,and explain the resonable use of the Internet age.With the expression bag hidden in the commercial value of the excavation,there will be more network expression outside the scope of the package infringement.In view of the difficulties in the protection of the expression package,we should strengthen the awareness of copyright protection,the network platform and the third party supervision.
