台湾地区维护互联网安全的法律与思考

A Study of Internet Safety Laws and Insufficiency in Taiwan

21世纪网络新兴犯罪通过妨害计算机正常运作、窃取计算机个人信息、冒用身份和利用网络购物诈骗,侵犯个人的人格权和财产法益;公共网站也遭到黑客入侵,导致特定网络系统瘫痪,如我国台湾地区发生铁路网络订票系统遭到黑客干扰,致使一百多万张花东线高铁车票消失。显而易见,网络新兴犯罪的被害对象和目标,已逐渐从个人计算机延伸至官方网站系统。计算机内电磁纪录一旦遭到窃取,还可能衍生个人信息的转手侵害的问题,因此确保网络安全的措施不容忽视。本文以我国台湾地区常见的三种网络新兴犯罪为背景,包括破坏计算机系统、窃取个人资料、网络诈骗活动,以检讨法制作为仍有未臻完备之虞,而我国的《网络安全法》正好提供了诸多参酌意见。

Facing the emerging attacks of the 21st century network,from hindering the normal operation of the computer,the intrusion of computer to steal personal information,the use of identity,and as well as the infringement of personality rights and property legea benefits;moreover,the public network security of the government,medical institutions and other official websites has been hacked,resulting in a specific network system paralysis.In addition,the potential risk of endangering national security has also appeared in Taiwan,causing railway network's booking system shut down which lead to over 1 million tickets to the eastern line disappear.In other words,the victims of cyber crime have gradually expanded from personal computer to official website;once personal data in computers with the electromagnetic records are stolen,personal informaion may be transferred from place to place,thus cyber safety can on longer be ignored.Upon the background of safeguarding the Internet order and personal privacy security,this paper examines the insufficiency of the legislation and judicial orientation of Taiwan,and Mainland's Internet safety law provides many constructive opinions for reference.
