信用卡网络支付服务市场的反垄断问题研究——从U.S. v. VISA案说起

摘要 网络支付服务平台同时拥有消费者端和商户端的消费者,商户对信用卡支付服务的需求取决于有多少消费者将采取信用卡进行支付,消费者对信用卡的需求也取决于有多少商户愿意接受信用卡支付。信用卡网络支付服务市场是典型的双边市场。在涉及双边市场主体的反垄断案件中,主要的难点在于双边市场主体的相关市场界定。基于单一市场中消费者剩余需求的SSNIP测算法在对双边市场的相关市场界定时,往往具有先天的不足。改进的临界损失法界定双边市场的方法更好体现一边市场提价后,对另一边市场需求的联动影响,测算结果更具有可靠性,属于目前测算双边市场的相关市场最优的办法。 The demand for credit card payment service depends on bow many consumers will use credit card for payment, and the demand for credit card by the consumer also depends on how many merchants are willing to accept credit card payment. Credit card online payment service market is a typical two-side market.In antitrust cases involving two-side market subjects, the main difficulty lies in the relevant market definition. The SSNIP method based on consumer surplus in a single market is often deficiencies in the definition of the relevant markets for two-side markets. The improved critical loss method is better reflects the network effect of two-side market, and the calculation result is more reliable. It is the best method for measuring the relevant markets in the two-side market at present.
