Analysis of the case of a Chinese medicine clinic run by an institution without the record of the competent department of Chinese medicine

为更好地学习领会中医药法的精神实质和内容,把握和处理中医药法与相关法律、法规的关系,做好中医药执法监督工作。通过案例分析的方式探讨中医药法实施以后,面对中医类非法行医的法律适用原则,提出加强监管队伍中医类别执法能力,建立信用惩戒体系,进行全面、动态的监管模式,以实现对中医药行业的有效监管。

To better understand the essence and content of Chinese Medicine Law,to grasp and handle the relationship between'Chinese Medicine Law'and relevant laws and regulations,and to improve supervision of law enforcement of Chinese medicine,through case analysis,this paper discussed the legal application principles of illegal practice of traditional Chinese medicine.Authors proposed to strengthen the supervision team Chinese medicine class law enforcement ability,establish a credit discipline system,and to conduct a comprehensive and dynamic regulatory model,to achieve effective regulation of the Traditional Chinese medicine.
