Legal Analysis on the Review and Revision of the International Telecommunication Regulations( ITRs)

《国际电信规则》是国际电联重要的国际电信多边条约,对其审议和再修订不仅涉及《国际电信规则》在全球电信新趋势下的功能和定位,还涉及国际电联未来职能范围变化等重大问题。近期,国际电信联盟理事会召开理事会工作组会议和专家组会议,审议了2012年修订的《国际电信规则》。通过全面解析和评论各成员方对《国际电信规则》的主要观点可以发现,在国际电信新趋势下,《国际电信规则》面临着三大问题,即,发达国家与发展中国家之间'数字鸿沟'不断拉大;各成员方都面临着日益严峻的网络与信息安全问题;国际上缺乏普遍有效的网络安全与个人隐私保护的国际规则。《国际电信规则》的再修订应围绕上述问题,并对世界电信的未来发展起到前瞻作用。

ITU Council Working Group Meeting(CWGs)and the Second and the Third Meetings of the Expert Group on International Telecommunication Regulations(EG-ITRs)were held in Geneva in September,2017 and January 2018 in Switzerland,undertaking a review of the 2012 ITR.ITR is an important multilateral treaty of international telecommunications.The review and Re-revision of ITR not only involves the function and positioning of ITR in the new trend of Global Telecommunication but also involves major issues such as the change of ITU’s function in the future.This paper makes a detailed analysis of the proposals made by some member states at the second meeting of the ITR Expert Group.The paper also analyzes the main points of the representatives of the Member States and the main problems faced by ITR under the new trend of International Telecommunication.The'two propositions'and'three proposals'proposed by the Chinese government at the third meeting of the ITR Expert Group are presented.Meanwhile,some suggestions on the applicability and Re-revising of ITR in the new trends of International Telecommunications are put forward.
