网络交易监管的管辖权配置研究

Research on Administrative Law Enforcement Jurisdiction of Network Platform Transaction

网络交易的整体性、跨区域性等空间特点,以及网络交易信息的平台集中化、电子化等数据特性,对传统上以行为的物理空间位置为联结点而配置地域管辖权的行政监管模式的有效性和效率构成挑战,提出了网络交易监管管辖模式改革的需求。应当根据网络交易的整体性、统一性、信息化等特点,反思传统的属地管辖模式,建立以大型交易平台所在地的专门机关监管的模式,在组织法层面设立专门的、专业化的网络监管机构,赋予其统一的监管管辖权。同时,结合网络交易的特点,充分发挥网络交易平台的作用,促进专门机关和网络交易平台的协同监管。

The spatial characteristics of the overall and cross-regional nature of online transactions,as well as data characteristics such as centralized and electronic platforms for online transaction information,challenges the effectiveness and efficiency of an administrative regulatory model that traditionally configures geographic jurisdiction with the physical spatial location of the behavior as the pointof association,proposed the need for the reform of the network transaction regulatory jurisdiction model.It should be based on the integrity,unity and informationization of online transactions,rethinking the traditional territorial jurisdiction model,establish a model for supervision by specialized agencies at the location of large trading platforms,establish a specialized network regulatory agency at the level of the organization,give it a unified regulatory jurisdiction.At the same time,combined with the characteristics of online transactions,give full play to the role of the online trading platform,and promote the coordinated supervision of specialized agencies and online trading platforms.
