摘要
最高额抵押的设立 ,应由当事人订立最高额抵押合同 ,以明确各方的权利义务。立法对最高额抵押宜采用登记要件主义 ,应统一我国的抵押登记部门 ,完善抵押登记的程序和内容。最高额抵押的变更如涉及第三人利益 ,对变更前抵押物上的其他担保物权人应不具有对抗力。
For the establishment of maximum amount mortgage, the party concerned should conclude a maximum amount mortgage contract, to make the rights and obligations definite. It is suitable for legislation to adopt registry of important conditions. It is necessary to unify the departments of registration of mortgage, and perfect the procedure and content of registration of mortgage. If involved with the interest of a third party, the change of maximum amount mortgage has no counter force to other property right guarantors of the guaranty before change.
