文章就古代保辜制度如何为现行刑法、刑事诉讼法所借鉴提出了构想:借鉴保辜制度,首先应转变传统的义务本位法律价值观,确立人权保护、人权保障的观念;其次,在刑法方面、刑事诉讼法方面,亦可借鉴保辜制度,建立犯罪复原制度及扩大自诉范围等。

The paper visualizes how the criminal law and law of criminal procedure can benefit from the ancient'Baogu'system.To refer to the system,it' s first required toshift from the traditional legal value of duty standard to that of the protection and security of human rights.Second,in terms of criminal law and law of criminal procedure,in light of'Baogu',the system of criminal rehabilitation can be established and the scope of private prosecution be expended.
