摘要
惩罚性违约损害赔偿是对补偿性违约损害赔偿制度的重要补充,它可以全面补偿受害人的损失、惩罚和遏制不法违约行为,具有重要的理论和实践价值。本文研究了惩罚性违约损害赔偿的必要性、适用条件及其适用范围。是对我国建立惩罚性违约损害赔偿制度的有益探索。
Punitive damages in breach of contract, which could completely compensate the damages of victim, amerce and restrain the illegal breach, is the important supplement of the system of compensatory damages in value both in theory and in practice.This paper studies the requirement of application, scope of application and necessity of punitive damages in breach of contract, making beneficial explorations for our county to establish the system of punitive damages in breach of contract.
