永佃权之重构——兼析《农村土地承包法》中农村土地承包权理论之源

Reconstruction of the Perpetual Tenancy——Analysis on the Basis of the Theory of the Contractual Operation Rights in Countryside

从永佃权理论的产生背景、发展、永佃权人享有的权利、永佃权的存续期间以及永佃权人的保护五个方面,探析了《中华人民共和国农村土地承包法》中农村土地承包经营权理论与永佃权理论的相似之处,进而得出后者是前者主要理论基础(或依据)的结论。

Beginning with five aspects including the background and development of the theory of perpetual tenancy,the rights of tenants, the duration of perpetual tenancy and the protection of tenants,this article probes the similarities between the theory of the contractual operation rights prescribed in PRC Law of Countryside Land Contract and the theory of perpetual tenancy. Finally, it draws the conclusion that the latter is the main theoretical basis of the former.
