从香港法上的分居制度引发的思考

Reflections on Separation with Reference to Hong Kong's Legal Practice

内地和香港婚姻家庭法方面的比较研究具有重要的意义。分居制度是内地没有的法律制度 ,香港婚姻家庭法上的立法、司法经验对内地分居制度的建构有着重要的参考价值。该文从婚姻家庭关系的特殊性出发 ,着眼于分居制度的功能 ,分析了香港婚姻家庭法分居制度的基本经验 ,阐明了其对内地婚姻法以及分居制度的启示 ,并对我国如何设立分居制度提出了立法建议。

It is significant to have comparative studies of the marriage and family law of China Mainland and Hong Kong. The legislative and judicial practice on separation in Hong Kong's marriage and family law is referential. While expatiating on the Hong Kong's legal practice on separation, this paper firstly analyzes the function of the separation from the angle of particularity of the marital relationship, and then tries to make some suggestions on establishing separation in China mainland's law.
