对城市房屋拆迁中发生的纠纷,究竟是作为民事案件还是作为行政案件来受理?对这一问题,不管是在法律规定上,还是在司法实践中都存在一些差异和混乱。笔者认为应当作为民事案件受理,并提出解决拆迁纠纷的思路及方案,以期与同仁探讨。

Should it be disposed of as a civil case or an administrative case to the issue of relocation in a city? There are some differences and confusion on the issue not only in legal regulation but in judicial practice. The author believes that the issue should be disposed of as a civil case. At the same time, the article provides the thinking and plan to settle the issue of relocation. The author expects to make a further inquiry with other colleagues.
