摘要
对我国现行的结婚条件及其立法进行分析,提出了完善我国结婚条件的立法建议:以禁止性规定的方式来要求结婚的必备要件;扩大禁止结婚的消极要件的范围;实行登记与仪式相结合的结婚程序;增设结婚登记公告制度。
The paper, based on an analysis of the current conditions of marriage as well as its legislation in China, offers suggestions on improvement of the legislation under discussion. Among other things, it proposes to include prohibitory regulations as compulsory requirements for marriage, to widen the scope of negative requirements for prohibition of marriages, to practice a marriage procedure combining registry with ceremony, and to introduce the publication system of marriage registry.
