On the Establishment and Legal Protection of the Patent Technology's Innovation System

专利技术创新机制主要体现在:按科研成果的私人产品和公共产品属性建立两种不同的运行机制;建立运用知识产权制度促进专利技术创新的利益激励机制;专利技术的重点由过去以增加专利数量为主,转向以提高专利技术含量为主。要善于保护专利,提高我国专利保护水平,首先就要抢先申请专利;其次,要建立健全专利保护机制;还要按照TRIPS协议的有关规定,在专利保护方面,注意扩展专利认定和保护的范围。

The patent technology innovation mechanism mainly embodies as follows:to build two different operational mechanism according to the property of private product and public product of the scientific research achievements; to build the interest incentive mechanism through applying intellectual property to facilitate the patent technology innovation; to shift the emphasis of the patent technology from number to the patent technological qualification. We should be good at patent protection. To upgrade our country's patent protection level, we should, first of all, preemptively apply for the patent, secondly, to establish and perfect the patent protection mechanism. Thirdly, in accordance with the regulations of the TRIP agreement, we should enlarge the category of patent identification and protection in the respect of patent protection.
