摘要
当代政府与公务员的关系是一种法律预先设定的公共服务协约关系,在这种关系中,公务员在身份保障、劳动报酬、集体协商、公正对待、隐私保护、档案查阅、依法辞职、申诉控告等方面享有权利。中国公务员的权利规范存在重经律约束、轻权利保障等问题。
The contemporary relation between government and civil servants is stipulated in advance in law for that of public service bargain. In the relation, civil servant enjoy generally the following rights: status protecting, payment for labor, collective bargaining, just treating, private matter protecting, looking up private archives, resignation, appeal and charge, and so on.
