摘要
《国家赔偿法》的制定,落实了宪法的规定,使国家赔偿制度化。然而在实践中暴露的问题迫使我们重新审视这部法律的意义和缺陷,反思这部法律的诸多不合理、不完善之处,重构国家赔偿制度,切实保障当事人的合法权益。
The constitution of the Law of the People's Republic of China on State Compensation puts the related regulations of China constitution into effect and makes the state compensation as a system. But the problems revealed in the experience spur us to rescan the meanings and defects of the law, to rethink the unreasonable and unperfect points of the law, and we should reconstruct the system of the state compensation and guarantee the parties' rights and interests that are within the law.
