摘要
在市场经济条件下,房地产抵押是最主要的担保形式之一,但因房产与地产之间关系的复杂性,使实践中的房地产抵押存在多种形式。通过对房地产抵押中的三种情形房产和地产的同时抵押、单独抵押、分别抵押的概念及理论依据的分析,并结合我国房地产抵押的实际情况,以期界定不同的房地产抵押形式。
This paper made an analysis of the concepts and justifications of three forms in real estate mortgage concerning the houses and the land mortgages-simultaneous mortgage;independent mortgage,separate mortgage-and gave definitions for them each in China's real estate mortgage market.
