Was There No Administrative Law in Ancient China?

主流观点认为,"中国古代没有行政法"。其实,从行政法的三个重要组成部分———行政组织法、官吏法和监察法三方面对古代行政法作一简要分析,可以说明古代行政法不仅有,而且有许多理念、制度、原则值得现代行政法借鉴,我们应以史为鉴,形成古代行政法与现代行政法的互动。

The mainstream viewpoint holds that 'there was no administrative law in the ancient China'. Yet, based on an analysis of the three important components of the ancient administrative law: administrative organization law, official regulations and supervision acts, it can be found that there is not only ancient administrative law in the ancient China, but also many concepts, systems and principles that should be studied and referred to by the modern administrative law. Hence, we should take a lesson from history and stimulate the mutual relationship between ancient administrative laws and the modern one.
