情事变更原则国际法渊源辨析——兼论《联合国国际货物销售合同公约》第79条的性质

长期以来 ,理论界多数人以为《联合国国际货物销售合同公约》第 79条是情事变更原则的国际贸易法渊源 ,其谬误之处在于片面理解了不可抗力是情事变更的绝对情事 ,混淆了不可抗力是情事变更的可能事由与不可抗力必然导致情事变更之间的界限。《公约》第 79条的性质理应属于不可抗力违约免责制度 ,并不是情事变更原则的依据。 196 9年《维也纳条约法公约》第 6 2条以及《国际商事合同通则》第 6 .2 .1——— 6 .2 .3条分别是情事变更原则在公法和私法领域内的国际法渊源。
