完善数据库的知识产权保护制度

Establish Legislation on the Intellectual Property of Databases Protection

数据库的知识产权保护关系到制作者的权益和社会公众信息自由平衡的两难选择 ,如何确立行之有效的保护制度也是理论研讨和立法实践至今未能得到妥善解决的困惑。本文在探究各种保护方式理论的基础上指出我国现行版权保护的不足并提出单一模式的法律保护对于数据库这一新兴产业明显无法遏制侵权行为而应采用“双轨制”:即在“内容的选择和编排上具有独创性”的数据库采用传统的版权保护和建立数据库特殊权利保护体系以促进数据库产业的投资和制止不劳而获的“搭便车”行为。

The Intellectual Property of Databases protection is related to two difficult choices between the right of producer and the information freedom of public.How to establish effective protection system is a puzzle,which has not been properly solved in the field of theory study and legislation practice.Analyzing theories of all kinds of protection modes ,this paper points out the deficency of copyright protection in China and we should establish ‘double-rail’ mode to get the balance of producer's rights and public information freedom.
