摘要
商业习惯是经济立法的渊源之一。在众多的商业习惯中,经济法对于符合市场交易秩序的商业习惯表示了尊重和认可的态度;而对于侵害市场秩序的交易习惯,则是采取了限制、调整的态度。并以回扣、格式合同、有奖销售三种常见的商业习惯为例说明了上述观点。
Business custom is one of the sources of economic legislation.The economic legislation approbates the business custom that accord with the business order,while restricts the business custom that break the business order.The paper illustrates the idea according to listing backhander,format contract,awarding distribution.
