A Study on Case Law——At the Point of Civil Action

判例法是英美法系最主要的法律渊源 ,经历了几百年的发展历程 ,形成了完整的理论体系。判例法拥有成文法所不具备的一些特点 ,在功能上起到了对成文法的补充和完善 ,具有十分重要的借鉴意义。本文通过对判例法的概念、历史沿革、理论基础及其功能和缺陷的论述 ,初步建构出适宜目前我国采用的判例法制度模式。

Case Law is the most important legal source of British and American le gal system. It has been developed for several hundred years, and has formed a pe rfect theoretical system. Case Law has some features that Statute Law hasn't ,an d better it on the function , so there are many things to learn from it . This a rticle , by analyzing it's concept , historical development , theoretical fundam ent , function and defects , establish a new Case Law regime which fit for prese nt Chinese conditions primarily.
