论我国庭前证据交换制度的完善与发展

On the Improvement and Development of the Evidence Exchan ge System before Holding a Hearing in Our Country.

庭前证据交换制度的存在顺应了理性对话的要求 ,顺应了现代诉讼的交流主旨。庭前证据交换制度在诉讼效率上的价值也是显而易见的 ,但是 ,目前我国庭前证据交换制度还有不太完善之处。本文对我国庭前证据交换制度实施过程中存在的问题进行了初步探讨 ,对完善我国庭前证据交换制度提出了一些建议 。

Evidence exchange system before holding a hearing meets the requirements of rati onal communication£conforming to the communication goal of modern lawsuit. Obviously its value can be revealed in the lawsuit efficiency.However,at present the evidence exchange system before holding a hearing in our country is still n ot perfect.In this article,I have made a preliminary research into the problems arising in the process of applying the evidence exchange system.Some suggestions are put forward to better the evidence exchange system before holding a hearing in our country,so that those committing themselves to the science of the law ca n draw some inspiration from the article.
