《摩奴法典》与古印度婚姻制度法律化

古印度后吠陀时期是奴隶制确立巩固时期,社会各种主客观因素与历史时代的大背景促使《摩奴法典》的颁布。它虽是宗教性法典,却已经具备了一般法典的基本特征,它是古印度社会宗教教义与世俗民风的融合体。正是该部法典才使古印度原本无序的婚姻状况开始走上法律化、制度化的轨道。法典以法的形式所作出的规定,对深化婚姻制度,规范婚姻各方的行为起着重大的作用,产生深远的影响。

The later VEDA eraf the ancient India was the era that the slavery had been established and reinforced. The varieties of objective and subjective factors of society and the historical backgrounds promoted the issue of the Mana Va - Dharma - Sastralois de Manou. Though a religious code, it contained the basic features of the general codes. It was the fusion of ancient India religious doctrines and secular customs. It was just the code that made the disordered marriage of ancient India run into the orbit of leaglization and systematization. The institution coming from the law had a significant and profound effect in deepening the marriage system and normalizing the forms of marriage.
