Creation of International Commercial Arbitration Center upon the Trend of Internationalization——Example of Xi'an International Commercial Arbitration Center

商事仲裁从起源之初就具有高度的民间性、自治性和普遍性。在全球化的背景下,商事仲裁制度已逐渐发展出完善的国际化模式并出现趋同性运作,同时,亦愈发凸显出其公共服务中的专业性、商业性及激烈竞争性。创建西安国际商事仲裁中心既是西部地区经济深入发展的必然需求,也是提升西部投资环境和国际形象的重要因素。既要在现行法律框架中探索合规的创设路径,也要坚守仲裁民间性和公正性的理念,还要着力于仲裁服务的品牌化和国际化。

Commercial arbitration has the characteristics of civilian, autonomy and universality at birth. At the background of globalization, its professional and commercial character and competitiveness are further highlighted. Creating Xi’an International Commercial Arbitration Center is an inevitable demand for deeper development of regional economy, and additionally an important factor to improve the investment environment and the international image of western region. It is necessary to explore the legitimate path for creating Xi’an International Commercial Arbitration within the existing legal framework, and importantly adhere to the ideas of civilian and justice in arbitration, and emphasize the branding and internationalization of arbitration services as well.
