秩序重建与乡村治理的法治化——关于恩施市沐抚办事处基层社会治理创新调研的再思考

乡村基层社会的治理问题,是党的十八届三中全会提出的"创新社会治理体制"重大命题的重点和难点。这要求乡镇一级政府有所作为,积极探索新思路和新办法,为体制创新提供原始素材。恩施市沐抚办事处在日常的工作中逐渐摸索出"层级调处"和"法律援助"相结合的治理方案,"办法很土,效果很好"。究其缘由,其中奥妙端在于,一是大力培育乡村积极分子,重建熟人社会的乡村秩序;二是重视基层社会治理的法治化,主动向当地村民提供多维的法律服务。

The problem of governance of rural society is the key point of the policy "The innovation of social administration system", which was proposed in the Third Plenary Session of the 18th Central Committee of the Communist Party of China in 2013. The first-level township government should make some effort is to explore new ideas and new methods positively which serve the construction of the new administration system eventually. The township office of Mufu, Enshi Prefecture has gradually explored a kind of new scheme of governance of rural society which combined "multilevel mediation" with "legal aid". The experiment has obtained considerable practical effect. There are two main reasons for its success: first, reconstructing the acquaintance society with the help of rural community activists; second, providing multidimensional legal services for the local villagers by the local government.
