关于互联网金融背景下网络银行监管策略研究

The Research on the Strategy of the Regulation on Network Banks under the Background of Internet Finance

近年来,随着电子商务的日益发展、网络技术的不断成熟和网络客户群的日益壮大,网络银行建设与发展成为不可逆转的趋势。在互联网金融背景下,网络银行的发展呈加速成长的特征。虽然网络银行与传统银行相比有着无可比拟的优势,但是它也并非十全十美。不但网络银行的虚拟性、创新性、突破时空性、适时性等特点给监管工作出了诸多难题,而且网络银行新的风险特征,如技术安全性风险、法律漏洞风险、流动性风险又给监管工作提出了新的挑战。对传统意义上的商业银行监管我国已经形成了较为完整的体系,对网络银行的监管仍处于探索之中,通过对网络银行与传统银行进行对比,可以较为准确地分析网络银行监管中的重点与方向。当前,我国加强网络银行监管必须从加强立法、严格准入、提升技术管理水平和行业自律等多方面入手。

In recent years,with the development of e-commerce,the maturity of the network technology and the growth of the network customer group,the construction and development of network banks have become an irreversible trend. In the context of the Internet finance,the growth of the network banks has been accelerated. Although the network bank has incomparable advantages compared with traditional banks,it is not perfect. Not only the characteristics of the network banks such as virtuality,innovation,unlimited time and space and timing etc. bring many problems to the regulation,but also the new risk characteristics of the network banks such as technical security risk,legal risk and liquidity risk puts forward a new challenge to the regulation. A relatively complete supervision system on the traditional commercial banks in China has been formed,but the supervision system on the network banks is still in the exploration. Through the comparison between the network banks and the traditional banks,the paper can more accurately analyzes the focus and direction of the supervision on the network banks. At present,measures must be taken to supervise the network banks in China such as strengthening the legislation,being strict with the access,enhancing the level of technical management and the industry self-discipline and so on.
