论民族法学之“个案研究方法”

On Methods of Case Study of Ethnic Law Science

民族法学是以民族法为主要研究对象的一门年轻的法学学科。民族法具有浓厚的民族文化属性,因而民族法学具有民族学和法学的复合性。民族学主要通过田野调查和民族志撰写的研究方法发现典型的民族生活素材(真相);法学则主要通过实证分析研究,寻求社会存在的运行规律(真理);二者结合即为民族法学的"个案研究方法"。采用这一科学研究方法有助于提升民族法学的实用效果和学术品质。

As a new discipline of law,ethnic law science focuses on ethnic laws.Ethnic law has profound features of ethnic culture.It has an integrated feature of ethnicity and legislature.Ethnology mainly works out ethnic materials of life(the fact)through field investigation and ethnic records.Law science searches for the operating rules(the truth)of social existence.The combination of these two forms the methods of case study of ethnic law science.The adoption of this scientific research method will enhance the practical effect and academic quality of ethnic law science.
