监督与制约:检察机关行使调查核实权的困境及其改进

Supervision and Restriction: Dilemma and Improvement of Procuratorial Organs' Implementation of Investigation and Verification

随着司法体制、监察体制改革的深入推进,检察机关和监察机关面临着权力制约和监督关系的进一步调整和完善。作为控权制度的两种基本方式,制约与监督在权力关系和权力结构上具有不同的内在逻辑、运行机制和作用效果。新修订的《人民检察院组织法》虽赋予了检察机关调查核实权的锋利"牙齿",但在"一府一委两院"的权力结构中,检察机关与监察机关"互相配合、互相制约"的权力关系在司法实践中仍面临法律监督与权力制约的双重困境。为进一步巩固监察体制改革的成果,保障检察机关法律监督职能的有效实现,在处理检察机关与监察机关的权力关系上需进一步调整思路,从权力制约和监督两个方面改进调查核实权行使的制约和监督机制。

With the advancement of judicial system and supervisory system reform,procuratorial organs and supervisory organs are confronting the issue of further adjustment and perfection of power restriction and supervisory relationships.As two basic ways of power control system,restriction and supervision have different intrinsic logic,operation mechanism and effects in terms of power relationship and structure.In the newly revised edition of Organic Law of the People’s Procuratorates,procuratorial organs are granted real power of investigation and verification.However,in the power structure of'one government,one supervisory commission and two courts'procuratorial organs and supervisory organs are supposed to mutually cooperate and restrict,but in judicial practice,they are faced with dual dilemma of legal supervision and power restriction.In order to strengthen the achievements of procuratorial system reform,guarantee the effective realization of legal supervisory functions,we should further adjust mentality in handling power relationship between procuratorial organs and supervisory organs so as to improve the restriction and supervision mechanism of investigation and verification from the two aspects of power restriction and supervision.
