随着云储存便捷的运作环境、服务密集的同步操作建模以及资源互享的途径多元的群集趋势之演变,公民个人信息的'云平台'储存已经逐渐流变为一种'泛云端化'特质。在网络空间与现实空间的'双层场域'下,衔接两种情境下侵犯公民个人信息罪的法益类型与具体要素的解读,是对既定客观事实的遵循与回应。基于法教义学分析,侵犯公民个人信息罪所侵犯的具体法益类型应当界定为'公民个人信息自决权',而理解侵犯公民个人信息罪法益所涵盖的具体要素,则可以从法益类型所指的'对象、主体、程度与范围'这四个要素出发。

With the development of convenient operation environment of cloud storage,service-intensive synchronous operation modeling and multi-way cluster trend of resource sharing,the'cloud platform'storage of citizen’s personal information has gradually become a'pan-cloud'characteristic.Under the'double-level field'of cyberspace and real space,the interpretation of the types of legal interests and specific elements of the crime of infringing upon citizens’personal information under the two situations is a follow-up and response to the established objective facts.Based on the analysis of legal dogmatics,the specific types of legal interests infringed by the crime of infringing on citizens’personal information should be defined as'citizens’rights of self-determination of personal information'.To understand the specific elements covered by the crime of infringing on citizens’personal information,we can proceed from the four elements of'object,subject,degree and scope'signified by the types of legal interests.
