摘要
土地是农业农村发展之本。土地整治是合理配置土地资源,实现土地资产保值增值的一条切实、有效的途径,并已上升为国家重大战略。但由于我国历史上土地制度几经变迁,权利主体多元、权属分布细碎化,同时土地整治法律缺位,公众参与渠道不畅通,土地整治过程中权属纠纷较为高发,不仅同一层次的权利主体间对相同性质的土地权利存在纠纷,甚至不同层次权利主体、不同性质权利之间也存在纠纷。研究表明,与农村土地征收不同,农村土地整治本质上应是在政府主导下的权利主体受益性、自治性活动,因此应充分发挥权利主体的治理积极性,畅通公众参与渠道,同时制定完善统一的土地整治法律、制度,并积极引导权利主体将矛盾导入法律途径,维护农村土地权属的稳定,为土地流转实现集约经营奠定基础。
Land is the foundation of agriculture and rural development.Land consolidation is a practical and effective way of rational allocation of land resources as well realizing land assets value,which have been rising for the national major strategy.Because of the land system changed several times in the history of China,the right subject pluralism,the fragmentation of ownership distribution,and for the absence of land consolidation law,public participation channels is not opened up,land management ownership dispute is relatively high,not only the same level between the rights of the subjects of the same nature of land rights disputes,but even for different levels right subject,there are disputes between property rights.This paper argues that different from rural land expropriation,the rural land renovation should essentially in benefit,autonomy of government-led right subject activity,therefore should give full play to the enthusiasm of governance rights subject,open public participation channels,at the same time formulate unified land regulation law and system,and actively guide the right subject into legal conflict,maintain the stability of the rural land ownership,implement intensive management to lay the foundation for land circulation.
