两岸比较视野下主任检察官之角色定位与制度配置

主任检察官办案责任制作为祖国大陆新一轮检察改革之核心备受关注,而台湾地区主任检察官制度已然颇为完备。通观两岸制度运作,祖国大陆试点意在建设新型办案组织,完成办案组织从人民检察院向检察官主体的历史过渡;台湾地区则意在建立检察长与众多检察官之间的管理环节,更多倾向构架业务管理部门而非办案组织。祖国大陆现今试点多少借鉴台湾地区制度运作,却也面临着认识和操作的现实困惑,尚需过渡阶段完成试点思考与完善。基于此,祖国大陆主任检察官制度之发展应区分过渡时期,明确自身角色定位进行相应设计,并行立法努力奠定制度根基。
