Participating in the Investment Process in Bulgaria——Main Difficulties for Chinese Investors

全面了解保加利亚的涉外投资法律体系,不仅包括对该体系要素进行细致分析,而且也有必要对该国调整投资程序的所有国内法条款作出详细说明。其中,后者之所以会引起中国投资者的关注主要出于两个方面的原因:一是作为欧盟成员国的保加利亚是"一带一路"倡议的前沿国之一^([1]);二是更深入地了解保加利亚涉外投资法律体系将有助于"一带一路"倡议的实施。尽管中国与保加利亚在贸易往来、双边投资过程中存在着一些摩擦^([2]),但是就整体情况而言,中保贸易投资关系较为融洽,并且具有良好的发展前景。^([3])有鉴于此,研究保加利亚涉外投资的国内法,对于中国投资者正确认识到该国投资所面临的挑战具有重要的现实意义。

A logical continuation of the analysis about the elements of the Bulgarian foreign investment law system constitutes the detailed presentation with respect to the specific provisions on domestic level, which regulate the investment process in the country. This question could be of particular interest for Chinese investors, since the understanding of the country's foreign investment system would be able further to facilitate the realization of the Chinese Initiative "One Belt, One Road", as long as Bulgaria belongs to the "front-line" countries. Although some negative trends in the field of trade and investment between Bulgaria and China exist, in general a positive development has been observed. Thus, it is worth to continue the legal analysis with regard to the investment system in Bulgaria from Chinese perspective, focusing on the four typical questions, the answers of which could give a complete picture about all the relevant facts for doing an investment in the country: Who can invest? How to invest? What are the forms of investment? How to protect the investment?
