论大学章程对学生权利的保障——基于我国84部大学章程的文本分析

On the Protection of University Students' Uights by University Charter:Text Analysis Based on the Charter of 84 Universities

当前频发的教育诉讼案件,揭示了大学治理中存在高校侵犯学生权利的问题。大学章程作为大学内部的"最高法""根本法",在保障学生权利和提升大学内部治理能力的过程中,起到了重要作用。因此,本文以教育部已经核准的84所高校章程文本入手,对我国章程中学生权利保障条款的规定及落实情况进行分析,尝试从章程角度对大学侵犯学生权利问题产生的原因进行探讨。同时对今后大学章程的制定、修改和实施给出合理化建议,包括细化章程对学生权利保障的内容和强化学生参与机制。

Nowadays, the frequent cases of education reveal the problems of violating the rights of students in University governance. As a "supreme law" as well as"basic law"within the university, the charter of the university plays an important role in protecting students' rights and improving the internal governance ability of University. Therefore, the essay uses the 84 charters texts approved by the Ministry of Education to analyze the rulemaking and implement on the protecting of students' right, and then tries to find out causes of mentioned phenomenon. At the same time, the essay tries to give out reasonable suggestions for the formulation, revision and implementation of university statutes, including refining the contents about protecting students' right and strengthening the participation mechanism of students.
