On the Function and Features of Criminal Procuratorial Power in China: A Comparative Study

世界各国检察机关由于所属法系、诉讼传统、诉讼模式不同以及法律定位和设立模式的差异,享有的刑事职权均不尽相同、各有特色。比较分析各国审前、审理(庭审)、审后阶段检察机关刑事职权设置的模式、特点、规律,有助于更加客观公正深入地认识我国刑事检察权的职能定位和特点。

Due to the differences of belonging legal system, litigation tradition, litigation mode, legal status and establishing mode, the procuratorial authorities all over the world have been entitled to different but distinctive criminal powers. The comparative analysis of the establishing mode, character, regular pattern of the establishment of criminal power through the whole criminal trial procedure,which includes the pretrial, the trial and the posttrial stage,contributes to a deeper understanding of the functions and features of criminal procuratorial power in China.
