Back to the future?A review of The Future of Law and Economics

Guido Calabresi在其新书《法律经济学的未来》中阐述了两个核心理论:一是,在现实世界中,资源分配既可以通过修正的市场,又可以通过修正的行政手段,但到底采用何种形式进行资源分配,需要根据所分配资源的类型来决定;二是,过去的法律经济学研究进入了一个误区,法律经济学者往往忽视了一些特有的价值,例如,有益品、利他主义、品味和价值观等因素。Calabresi想重新定义并完善法律经济学的理论,试图用法律经济学的原理来解释更多的社会现象,并指明这个领域未来的研究方向。但是,Calabresi的努力似乎并未对法律经济分析的发展起到实质推动作用。

Guido Calabresi expounded two core theories in his new book " The Future of Law and Economics". However, Calabresi's efforts seemed that not have a substantial impetus to the development of legal economic analysis.
