摘要
跨界污染治理中的府际合作作为一种公权行为,其实施不仅要求具备必要性和可行性,也必须具备正当性。跨界污染府际合作治理的正当性证成,是夯实跨界污染府际合作治理法治基础的现实之需,是厘清跨界污染府际合作治理法律问题的基本前提,也是引导跨界污染府际合作治理制度建构的内在要求。它包括合作治理主体正当性之证成、内部合作关系正当性之证成、外部治理行为正当性之证成三个基本维度。对此,地方政府利益论、行政法律关系理论、行政管辖权让渡理论则构成了跨界污染府际合作治理正当性证成的理论谱系。
As a kind of public power,the implementation of intergovernmental cooperation in transboundary pollution control not only requires the necessity and feasibility,but also the legitimacy.The justification of intergovernmental cooperative governance of transboundary pollution is the realistic need to consolidate the legal basis of intergovernmental cooperative governance of transboundary pollution,the basic premise to clarify the legal issues of intergovernmental cooperative governance of transboundary pollution,and the internal requirement to guide the establishment of intergovernmental cooperative governance system of transboundary pollution.It includes three basic dimensions:justification of cooperative governance subject,legitimacy of internal cooperative relationship and legitimacy of external governance act.In this regard,the theory of interest of local government,the theory of administrative legal relationship and the theory of transfer of administrative jurisdiction constitute the theoretical pedigree of the legitimacy of transboundary pollution governance through intergovernmental cooperation.
