摘要
苏俄民法建立于公有经济基础之上,强调国家的干预与公私法的划分。新中国成立以来的历次民事立法,由于受到经济基础、政治结构及国际环境等诸多因素影响,苏俄民法在立法模式、具体制度与观念等方面对中国民事立法有深远影响。研究表明,植根于经济基础与政治结构之上的法律文化的融合是法律移植的生命所在。
The Russian Civil Code was enacted on the basis of public ownership which emphasized on the state intervention and the division of public and private laws.Since the establishment of the People’s Republic of China,due to die impact of various factors such as economic foundation,political structure and international environment,our civil legislation has been strongly influenced by the Russian Civil Code in terms of its legislation model,the specific institution as well as the legal concepts.All this manifests that the essence of legal transplantation lies in the integration of legal cultures rooted in economic foundation and political structure.
