Influence of Roman Law on Russian Law——Analysis Focused on the Effect of Eastern Orthodox Church

罗马法进入古代俄罗斯的最初方式为法律移植,之后为征战和贸易,并在签订的国际条约中表现出来。罗马法对古代俄罗斯法的主要影响是以东正教传播,以及教会法的适用为主要途径的。罗马法的引入不仅在俄罗斯创制了教会司法权,也对俄罗斯习惯法加以改造,并冲击了有关奴隶的法律制度。罗马法在古代俄罗斯的渗透和融合是通过东正教活动来完成的,东正教也成为罗马法进入古代俄罗斯的媒介。

Roman Law was transplanted into Russian Law at the beginning,thereafter shown in international treaties signed by Russia and other countries for wars and trades.The influence of Roman Law to Russian Law is mostly disseminated and applied by Eastern Orthodox Church.The introduction of Roman Law gave the church jurisdiction,reformed Russion customary law and impacted the slavery laws.Roman Laws permeation and fusion in to ancient Russia was by the Eastern Orthodox Church,which was the vehicle for the introduction of Roman Law.
