The Dilemma and Solution——Empirical Study on Juridical Confirmation of People’s Mediation Settlement Agreement

推行人民调解协议司法确认的价值和作用很大,但是以湖南省法院发出首份人民调解协议司法确认书的情况为分析样本,发现人民调解协议在司法实践中推行极为缓慢,让人感到困惑。对此,从当事人和法院两个视角对困惑进行一番原因的探索。随后,针对原因,在理性思考中寻求路径。

The judicial confirmation of mediation agreement by the People’s Mediation Committee is supposed to be valuable and practical;however,based on the analysis of the very first confirmation issued by court in Hunan,the author was confused that the judicial confirmation was applied rarely.Thus the author researched on the confusion from the perspective of the parties and the courts,and brought up suggestions of solution.
