关于人民调解社会治理功能的思考

自二十世纪八九十年代始,治理理论在全世界范围内盛行,其内涵得到不断丰富与发展。社会治理视阈下的人民调解制度作为我国法律规定的一项制度,在承担'纠纷解决'这一基本功能之外,在司法实践中还承担着纠纷预防、风险控制、人际融合、法治宣传、道德教谕、行政管理等社会治理功能。人民调解此类社会治理功能在给基层法治建设带来一定积极意义的同时,也使基层法治建设面临诸多困境。

Since the nineties of the 20th century,the governance theory has prevailed worldwide,in the meantime,its connotation has continually developing and enlarging.The people's mediation system which as a regime of chinese laws stipulating in the horizon of social governance takes the social function of dispute resolution,besides,in the prevention and risk control of dispute,dispute neutralization and interpersonal fusion,propaganda of the rule by law and moral enlightenment,public administration and service people in justice practice,it plays an important role.This social function of the people's mediation system play a posi-tive part in the basic construction of the rule by law,at the same time,it also takes dilemma of the basic construction of the rule by law.
