摘要
《什么是体育法》一书的问世,丰富了我国体育法学基础理论的研究,该书系国内首部从多元视角下探讨体育法内涵和术语含义的译文集。通过借鉴国外学者就'什么是体育法'这一问题的讨论,有助于我们对体育法独立与否、体育法的内涵与外延和CAS的发展历程等体育法基础性问题进行再认识。但是,该书对'Lex Sportiva'的术语含义和体育法的性质的解读还可以进一步商榷。为探究这些术语的真实法律属性,将'Lex Mercatoria'与'Lex Sportiva'进行类比研究,可以得出'Lex Sportiva'属于'全球法'的结论。同时,运用文献分析和逻辑分析的方法,可以认为体育法的性质应该被认定为行业法、全球法以及边缘综合性的法律。此外,从'行业法'的新视角,可以对体育法独立之合理性进行补充论证。
The publish of the book of“What is Sports Law”is the first Chinese translation collection of essays,which discuss on the connotation of Lex Sportiva and the meaning of Sports Law terms in the multivariate perspective,has enriched the theoretical basis about Sports Law study.This book provided experi-ence for discussion of theoretical basis about Sports Law study through referring some foreign researches,such as the independent of Sports Law,the connotation and extension of Lex Sportiva,the development course of CAS,etc.However,this book also have some shortcomings,particularly about the nature of Sports Law and the meaning of the term of lex sportiva.In order to find the legal attributes of this issue,through the analogical research on the terms of“Lex Mercatoria”and“Lex Sportiva”,it can be found that Lex Sportiva should be the member of“global law”.Meanwhile,using the methods of documents analysis and logic analysis,the nature of Sports Law should be Lex speciallis,global law and a frontier synthetic discipline.In addition,the data from Lex speciallis will be demonstrated to reinforce the reason why Sports Law can be an independent department.
