司法如何满足人民正义感?——试述苏永钦教授的司法公信观

How to Reform The Judiciary so as to Accord with The Aspirations of People:A Study on Professor Su Yeong Chin’s Thoughts on Judicial Credibility

苏永钦教授认为,司法的根本问题是公信问题,司法改革的正确路线应是引导司法裁判符合人民的正义感。首先,在法官选任上,应注重专业能力、审判独立和对多元价值的平衡。其次,在司法方法上,进一步完善大法官集中规范审查和普通法院分散审查的违宪审查。最后,在司法制度上,提高司法部门的自主程度,并通过参审制等具体制度措施、模式解决专业中心主义和法律工具主义带来的问题,改善司法品质,增强人民对裁判公正性的信心。

Professor Su Yeong Chin finds out that judicial credibility is the core of the judiciary,and the key to resolving the problems of judicial credibility is reforming the judiciary so as to accord with the aspirations of people. Firstly,in terms of the judge selection system,we should may more attention on cultivating professional skills,ensuring the independence of justice,and balance of various values. Secondly,some measures should be taken to improve the unconstitutional reviewing system,including the concentrate system and the dispersion system.Thirdly,the judiciary should be offered greater autonomy and relevant specific systems,like assessor system,are required to solve the problems brought by legal centralism and legal instrumentalism, to improve the judicial quality and to strengthen citizens’ confidence on judiciary.
