Reconstruction of Global Trade and Investment Rules

本文回顾了当前全球多边、区域和双边贸易投资谈判现状,并分析了多边框架和区域框架之间的竞合关系。本文认为,跨太平洋战略经济伙伴关系协定(TPP)、跨大西洋贸易与投资伙伴协定(TTIP)、国际服务贸易协定(TISA)和美式BIT(2012范本)代表了当前全球贸易投资谈判的最新趋势和进展,这也导致全球贸易投资规则处于重建之中。文章认为,全球贸易投资规则发生根本性变革的本质原因在于全球化发生了根本性改变,而全球贸易投资规则的演进和重构将主要体现在以下两方面:一是供应链相关的规则,二是海外市场规则。在此基础上,文章分析了TPP谈判对中国的收益与挑战,并进一步得出结论认为中国参与国际经济新规则构建应有全局意识和前瞻性思维,应全面参与全球贸易投资谈判。

This paper reviews the current status of multilateral,regional and bilateral trade and investment negotiations and analyzes the competitive and cooperative relationship between the multilateral and regional frameworks.The Trans-pacific Partnership Agreement(TPP),the Transatlantic Trade and Investment Partnership(TTIP),Trade in Services(TISA)and the Bilateral Investment Treaty with the US(BIT)represent a new trend in global trade and investment negotiations and are also leading to a reconstruction of global trade and investment rules.The authors believe that the reconstruction of global trade and investment rules is due to a fundamental change in the process of globalization.The reconstruction is mainly embodied in the rules related to global supply chain and overseas market rules.On this basis,the paper analyzes the TPP’s benefits for and challenges to China.It further concludes that China should take global consciousness and forward-looking thinking to its participation in new rules in global trade and investment.It should also be fully involved in the global trade and investment negotiations.
